Loch Fitty drainage: in breach of European law?
Kingseat Community Council, represented by Highland Environmental Law, has submitted a formal complaint to the European Commission, alleging that SEPA's authorisation of the drainage of Loch Fitty, in Fife, to allow opencast coal mining, breaches the European Water Framework Directive. This law allows such damage only if there are major benefits for human health, public safety or sustainable development, and there are no alternatives. The complaint challenges SEPA's beliefs that the loch can and will be restored, that there are no alternatives, and that climate change is irrelevant to the decision.
